Welcome to Living Cluster, operated by Lotez Technologies (OPC) Private Limited (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully.
Living Cluster provides a technology platform that facilitates apartment management services, including payment processing of maintenance fees from apartment residents to their respective apartment associations. We act solely as a technology service provider and aggregator and do not own or manage apartment associations.
To access certain features, you may be required to create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Payments made through Living Cluster are processed via third-party payment gateways such as Cashfree. All maintenance fee payments collected from apartment residents are transferred directly to the bank accounts of the respective apartment associations. Lotez Technologies (OPC) Private Limited does not charge any commission or markup on these payments.
Residents are responsible for paying any applicable payment gateway convenience fees or transaction charges.
Since payments are made directly to apartment associations, Living Cluster does not handle refunds or cancellations. Refunds, if any, are subject to the policies and decisions of the respective apartment associations. Residents seeking refunds or adjustments should contact their apartment association directly.
All content, logos, trademarks, and software associated with Living Cluster are the property of Lotez Technologies (OPC) Private Limited or its licensors. You may not use, reproduce, or distribute any part of our Services without our prior written permission.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not engage in any activity that disrupts or interferes with the Services or infringes upon the rights of others.
You agree to indemnify, defend, and hold harmless Lotez Technologies (OPC) Private Limited, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any rights of a third party.
We reserve the right to suspend or terminate your access to the Services, without prior notice or liability, for any reason including, but not limited to, breach of these Terms or suspicious activity. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
To the maximum extent permitted by law, Lotez Technologies (OPC) Private Limited shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; or (iv) any bugs, viruses, trojan horses, or the like.
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
Our Services may include integration or links to third-party services such as payment gateways (e.g., Cashfree) and communication platforms (e.g., WhatsApp Business API). We do not control these third-party services and are not responsible for their content, privacy policies, or practices. Use of such third-party services is subject to their own terms and policies. Any issues relating to payments, refunds, or transactions processed through these third parties must be resolved directly with the respective service provider.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the new Terms on our website or through the app. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively by the courts located in Hyderabad, India.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Lotez Technologies (OPC) Private Limited regarding your use of the Services.
We shall not be liable or responsible for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, fuel, energy, labor, or materials.
